Terms of Service
Last updated: October 11, 2026
Please read these Terms carefully. They explain the rules for using Denobulus hosting, domain and website services, including billing, renewals, suspensions, refunds and our uptime commitment.
1. About these terms
These Terms of Service (“Terms”) govern your use of the services provided by Denobulus, LLC, a Colorado limited liability company (“Denobulus”, “we”, “us”). By creating an account, placing an order or using our services, you agree to these Terms. If you are using the services on behalf of a business, you confirm you have authority to accept these Terms for it.
These Terms work together with our Privacy Policy and any plan details shown when you order. If a plan description and these Terms conflict, the plan description applies to that plan.
2. Services covered
These Terms cover:
- Shared Web Hosting plans (Starter, Grow and Scale).
- Managed WordPress Hosting plans (WordPress Starter, WordPress Grow and WordPress Scale).
- Domain registrations, transfers and renewals, which are purchased and renewed separately from hosting.
- Website Design projects and Website Care plans, where you order them.
- Add-ons such as additional storage, where available.
The features, limits and prices of each plan are those shown in our client portal at the time you order or renew.
3. Your account and security
You must provide accurate contact and billing details and keep them up to date. You are responsible for all activity under your account, including activity by anyone you give access to.
- Keep your passwords and access credentials secure, and do not share them publicly.
- Keep the software you install (for example WordPress, plugins and themes) updated and secure, except where a plan specifically states that we manage a particular update for you.
- Tell us promptly if you believe your account has been compromised.
We may require identity or payment verification before activating or continuing a service, and may decline or cancel orders we reasonably believe are fraudulent.
4. Billing and automatic renewal
Services are billed in advance for the billing term you choose. Unless you cancel before the renewal date, each service renews automatically for the same term at the then-current price, and the renewal invoice is charged to your saved payment method where one is on file.
Payments are processed by our payment processor, Stripe. Prices are shown in US dollars. Domain registrations and renewals are billed separately from hosting.
5. Late or failed payments
If a payment is not received, the following schedule normally applies. Timings are approximate and may vary slightly with system scheduling:
- Before the due date: we send an invoice reminder.
- Around 3 days overdue: we send an overdue reminder.
- Around 7 days overdue: hosting services may be suspended. Your client portal remains available during a suspension where technically supported, so you can pay the invoice.
- Around 30 days overdue: the service may be terminated and its hosting account removed.
Paying the outstanding balance before termination restores a suspended service where supported. Payment after termination does not guarantee that the account will be recreated automatically.
6. Suspension and termination
We may suspend or terminate a service for non-payment, for a breach of these Terms, to protect our systems, other customers or third parties, or where required by law.
After a normal termination, the final backup history for the account is normally kept for approximately 30 days and then deleted. Restoring a terminated account is a separate recovery process and is only possible while a usable backup still exists. We may delete data sooner where reasonably necessary for abuse, fraud, chargebacks, legal or security reasons.
We will try to give notice before suspending or terminating a service, except where immediate action is needed to stop abuse, protect security or comply with the law.
7. Cancellation and the 30-day money-back guarantee
You can cancel a service at any time from the client portal or by contacting support. Cancellation stops future renewals; unless the guarantee below applies, fees already paid for the current term are not refunded.
Money-back guarantee
New Shared Web Hosting and Managed WordPress Hosting hosting fees are covered by a 30-day money-back guarantee. To use it, cancel and request the refund within 30 days of the original order. The guarantee does not cover:
- domain registrations or domain transfers;
- renewals;
- SSL certificates or other third-party licences and products;
- Website Design;
- extra migration work beyond what your plan includes;
- other non-refundable third-party costs.
8. Upgrades and downgrades
Paid upgrades may apply immediately, with the price difference prorated where our billing system supports it. Downgrades are intended to take effect at renewal, and only where your current usage fits within the lower plan’s limits. Some plan changes may need to be completed by our support team rather than automatically.
9. Plan limits and resource usage
Each plan includes the limits shown for it, such as storage, monthly bandwidth, number of websites, email accounts and databases. Where a plan feature is described as unlimited, that refers to the absence of a fixed plan count, not unlimited use of shared server resources.
Our servers are shared. Accounts have limits on processor time, memory, processes and disk activity so that no single account degrades service for others. If an account uses resources in a way that affects other customers or the stability of the server, we may restrict, throttle or suspend it, and we will normally contact you to discuss options such as optimising the site or moving to a larger plan.
10. Backups
We take daily backups of hosting accounts and store them on a separate backup server, with 30 days of backup history. Backups are provided to help recover from problems, but they are not a guarantee that every change or file can be restored.
You are responsible for keeping your own copies of important data and content. Backups are not a substitute for your own records.
11. Email
Email accounts are provided for normal business and personal correspondence. We apply sending limits to protect deliverability and the reputation of our servers. You must not use our services to send unsolicited bulk email. We cannot guarantee delivery of messages to or from third-party providers, and mailbox storage counts towards your plan’s storage.
12. Uptime commitment and service credits
We aim for 99.9% monthly uptime for Shared Web Hosting and Managed WordPress Hosting.
How uptime is measured
Uptime is the percentage of minutes in a calendar month during which the web service on the server hosting your account is reachable, as measured by Denobulus’s monitoring systems.
Service credits
If monthly uptime falls below 99.9%, you can request a credit against the hosting fee for the affected service for that month:
- 99.0% to below 99.9%: 5% credit
- 95.0% to below 99.0%: 10% credit
- below 95.0%: 25% credit
Credits are calculated on the monthly equivalent of the hosting fee, are applied to your account for future invoices, have no cash value and are capped at 25% of that month’s hosting fee. Service credits are your sole remedy for missed uptime.
Exclusions
Downtime does not count towards the calculation when it is caused by:
- scheduled maintenance announced in advance, or urgent maintenance needed to address a security issue;
- your own code, configuration, plugins, themes, content or resource usage;
- suspension under these Terms, or action we take to stop abuse or address a security threat;
- domain, DNS or registrar problems outside our infrastructure, including DNS propagation delays;
- failures of upstream providers, third-party networks or services outside our reasonable control;
- attacks or events beyond our reasonable control.
Claiming a credit
Open a support ticket within 30 days after the end of the affected month, including the service and the approximate times affected. Your account must be in good standing.
13. Domains
Domains are registered through our registrar partner, NameSilo, and are subject to the policies of the registrar and of the relevant registry. Domain registrations and renewals are purchased separately from hosting. You are responsible for renewing domains you want to keep and for providing accurate registrant information. A domain that is not renewed may expire and could become unavailable to you.
14. Website Design and Website Care
Website Design is priced and scoped as a separate project. The project scope, deliverables and timeline are agreed when you order or when we confirm the project, and Website Design fees are not covered by the money-back guarantee. Website Care plans are recurring services covering the tasks described in the plan you choose; work outside a plan’s description may be quoted separately.
Premium content updates. The Premium Website Care plan includes up to five small content-update requests per calendar month, each requiring up to 30 minutes of work. Requests are normally completed within two business days after we have all the materials and access needed. Unused requests do not roll over to the next month. Small content updates include text updates, replacing images you provide, publishing content you supply, and updating contact information, business hours, pricing, links and similarly minor changes to existing pages. They do not include redesigns, new features, custom development, substantial layout changes, original copywriting, media production, SEO campaigns, migrations or major e-commerce changes. Larger projects are quoted separately.
15. Acceptable use and prohibited activity
You must use our services lawfully and responsibly. You may not use them to:
- host, distribute or link to unlawful content, or content that infringes the rights of others;
- send spam or unsolicited bulk messages, or host phishing, malware or other harmful software;
- attempt to gain unauthorised access to any system, scan or attack other networks, or interfere with other customers;
- run activity that places unreasonable load on shared servers, such as cryptocurrency mining or public file-sharing services;
- facilitate fraud, abuse or harassment.
We may remove content, restrict access or suspend a service to address abuse, and we may report unlawful activity to the appropriate authorities. To report abuse involving a service we host, contact us using the details below.
16. Third-party services and software
Our services rely on and integrate with third-party providers and software, including our payment processor (Stripe), our domain registrar (NameSilo) and software you choose to install, such as WordPress, plugins and themes. Their own terms may apply, and we are not responsible for third-party services, software or licences, including premium plugins or themes, that we do not provide.
17. Your content and intellectual property
You keep all rights to the content and data you store on our services. You give us only the permissions we need to host, back up, transmit and display it in order to provide the services. You are responsible for having the rights to everything you upload.
The Denobulus name, logo, website and client portal materials belong to us. Website Design deliverables are covered by the project terms agreed for that project.
18. Disclaimers
We provide our services with reasonable skill and care, but except where this is not permitted by law, they are provided “as is” and “as available”. We do not promise that the services will be uninterrupted, error-free or suitable for every purpose, and we do not guarantee results such as search rankings or sales.
19. Limitation of liability
To the fullest extent permitted by law, Denobulus will not be liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to a service is limited to the amount you paid for that service in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
20. Changes to the services or these Terms
We may update these Terms or change our services, for example to reflect new features, legal requirements or operational needs. When we make a material change, we will update the date below and, where appropriate, notify you by email or in the client portal. Continuing to use the services after a change takes effect means you accept the updated Terms.
21. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Except where applicable law requires otherwise, any dispute relating to these Terms or the services will be brought in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts.
